BlockMed Pro (the SAAS based digital platform/web portal) is referred to as "the Service" on this page. This page elaborates the Terms and Conditions that act as an agreement between "you" (the Consumer of our Site and/or Service), and "us" (BlockMed Pro UK Ltd.). This contract governs your use of our Site and Service. This agreement mentions the patients as "Data Sellers" and healthcare organisations (including laboratories and pharmaceutical organisations) as "DataPurchasers". Both Data Sellers and Purchasers are referred to as"Consumers" of the Site's content.
Disclaimer: Note that our services rely on some trusted partners ("third-party service providers") such as cloud hosting and payment processing services, in order for our platform to operate properly. By using our platform, you acknowledge and agree that your information and transactions may be processed by such providers (see details in our Privacy Notice) under their respective privacy policies. By accessing or using our Site and Service, you agree to comply with these Terms and Conditions. Please read them carefully. If you do not agree, please refrain from using our Site and/or Service.
By using our Site or registering on the portal via the Site, you agree to use it solely for lawful purposes and in compliance with all applicable laws.
BlockMed Pro UK Ltd. health-tech platform is a Marketplace that allows users to access, upload, and share their health records for monetisation and share data (anonymously) with third parties such as laboratories and pharmaceutical companies for the sake of research and analysis.
Patients can upload and/or make available their health data voluntarily.
Purchasers may access, request, and purchase data strictly for lawful, research, or clinical purposes.
The consumers are not allowed to misuse the platform (e.g., fraudulent submissions, unlawful processing, hacking attempts, etc.).
The following points explain the scope of this agreement and what is excluded:
Scope of Terms: The use of our Service will be governed under these Terms and Conditions.
Terms that are Out of Scope: The rules and regulations to use anything which comes with the Service as a third-party software/service or a part of it.
Sign-up Required: To access the features of BlockMedPro, you are required to create an account by providing your Email and Name and other required details depending upon your role (Data Seller or Purchaser). While signing up, you agree to provide accurate information and keep your account details secure. However, once signed-in, you are responsible for any activity on your account.
Permissions: We allow you to access and use our Service that this agreement is written for i.e., the Service you just purchased from us as a Consumer.
System Data Logs: BlockMedPro only audits/logs system activity conducted by the consumer on the platform such as creating an account, paying for a subscription, requesting data access, etc. We do not access or record any device data or location of the consumer(s).
User Submissions and Data Sharing with Third-Party: In some cases, our Service or one or all the third-party software/service providers may require you to submit your information with us (e.g., at the time of registration/sign-up) called User Submissions.
You understand that our Services may require you to interact with one or more integrated third-party software and/or service(s) to operate properly.
The Site may contain links to third-party websites or services, including pharmaceutical organisations, healthcare, and technology vendors, which may record your user submissions.
BlockMed Pro UK Ltd will not be responsible for any consequences of this third-party software or service interaction with your submissions. We will not be responsible for the content, policies, or practices of these third-party sites or companies, as an organisation as well as a Service.
Accessing any of the sites is at your own risk, and you should review their terms and policies in advance. In case any of these partners fails to function properly, we will not be responsible for the quality of services provided to you including that of the storage, networking, hosting, power, and others.
Account Termination: BlockMed Pro UK Ltd.reserves the right to suspend or terminate accounts that violate these Terms and Conditions or involve fraudulent activity.
Disclaimer: We will not be accountable for the costs of any losses or damage caused to any living beings, property, personal or business reputation, and others, or delays/interruptions, due to the failure of any or all of the above-mentioned.
We respect, and care for your data privacy. Therefore, we take appropriate physical, digital, and administrative measures to secure the data that we capture when you interact with our services. These measures are taken according to the rules and regulations of Data Security and Protection (as defined by UK GDPR, NHS, and DSPT), including other measures to maintain your data integrity and privacy. Our Privacy Policy governs the collection, processing, and storage of user data and is incorporated by reference into these Terms. By using our services, you acknowledge and consent to BlockMed Pro's data handling practices. Please review our Privacy Notice.
All content on the Site and within the digital platform/service including text , trademarks, branding (logos, designs, elements, etc.), and technology remain a property of BlockMed Pro UK Ltd.whereas the intellectual property rights of our compliance and regulatory bodies (including UK GDPR, NHS, DSPT) remain with them. You can not use, copy, or reproduce any of the above from our Site without prior written permission. You are only allowed to use the Site solely for personal and non-commercial purposes and cannot access the Service without registering an account with us (either as a data seller or a purchaser).
The eligibility criteria to use our Site and/or Service is mentioned as follows:
You must be at least 16 years old to use the Services per NHS rules and regulations.
Consumers such as patients or personal data sellers/owners must be registered with the NHS, having a unique NHS number assigned to every individual registered with the NHS with a registration ID.
Consumers such as laboratories and pharmaceutical organisations (data purchasers) must be registered with healthcare bodies with lawful authority to process health data in the UK or their jurisdiction and should have a unique Licence/Registration number or Organisation Data Service (ODS) code.
We may request verification documents before granting access, as required.
Under these Terms, you agree not to:
Use the Site for unlawful or harmful activities.
Transmit viruses, malware, or any harmful content.
Attempt to gain unauthorised access to other users' accounts.
Use automated systems to access the Site in a way that disrupts our servers or services.
Violation of these responsibilities may result in termination of your account and legal action from BlockMed Pro UK Ltd.
Your use of BlockMed Pro may include the sharing of pseudonymised data with any/all of the data purchasers(pharmaceutical organisations/laboratories), for research or analysis purposes, only with your explicit consent secured in Blockchain (under Smart Contract). This data is shared in a way that protects your identity. Please refer to our Privacy Notice for more information on how we handle and share data.
We act as a Data Processor for both Seller and Purchaser as we process it when patients register data with us and when purchasers request access to it.
All processing of personal data complies with the UK GDPR andNHS DSPT standards.The lawful bases for processing under UK GDPR Articles 6 and 9 are:
Article 6(1)(a) – Consent: Patients provide explicit, informed consent for the collection, storage, and use of their personal health data for defined research purposes.
Article 9(2)(a) – Explicit Consent for Special Category Data: Since health data constitutes special category data, BlockMed Pro obtains explicit consent through clear, affirmative opt-in mechanisms before any data is processed or shared.
All consents are documented electronically and can be withdrawn by the individual at any time through their user account settings.
Patient consent is explicit, recorded, and immutable via blockchain before any data transaction.
We use Google Cloud Platform (London (Europe – West 2 region)) and MongoDB Atlas for secure storage.
Data is retained only as long as necessary for processing and regulatory, contractual, and legal obligations. Retention policies of patients' basic data align with NHS DSP Toolkit standards and ICO data minimisation principles (Article 5(1)(c) of UK GDPR), typically no longer than 6 years unless required for legal, contractual or regulatory purposes. See Data Retention Policy for more details.
Data purchasers are responsible for ensuring lawful use of purchased data in compliance with GDPR and applicable healthcare regulations.
Certain features may be accessible only through paid subscriptions or one-time fee. Payments are processed through a secure third-party provider (Stripe, which is a PCI-DSS compliant payment provider). Patients will receive agreed payments once the Purchaser completes the transaction and we release payments after following the defined financial governance process. By making a payment, you agree to our payment terms and any additional terms provided by our payment processor(s).
We are not responsible for payment delays caused by Stripe or banking institutions.
To the fullest extent permitted by law, BlockMed Pro UK Ltd. shall not be liable for any damages, including but not limited to direct, indirect, incidental, or consequential damages arising from your use of or inability to use the Site. BlockMed Pro UK Ltd. is provided on an "as-is" and "as available" basis without warranties of any kind.
Note that we are not responsible for:
Accuracy of data uploaded by patients
Misuse of statistical/un-downloadable/anonymised data by purchasers once lawfully shared
Any indirect, incidental, or consequential damages
Please note the following disclaimers from BlockMed Pro UK Ltd.:
Correct Use of Service: The content on BlockMed Pro's Site is provided for informational purposes only and should not be interpreted as medical advice. Users should consult qualified healthcare professionals for medical diagnosis or treatment. BlockMed Pro UK Ltd. is not liable for decisions made based on information from the Site.
Unclaimed Funds: If a data seller does not withdraw their money from their Stripe accounts within 1 year of the transaction date, the unclaimed amount will be forfeited and donated to a registered charity chosen at our discretion. We will make reasonable efforts to notify the Seller before such funds are transferred.
Audit Disclaimer: We may suspend or terminate accounts if we find non-compliance with GDPR, DSPT, or NHS standards.
Consumer Permissions: Sellers agree to provide their NHS numbers or other details and purchasers agree to provide compliance documentation (e.g., DPIAs, DPA agreements) upon request.
Third-Party Payment Terms: By agreeing to these Terms and Conditions, you acknowledge and agree to Terms and Conditions of our financial partner Stripe, which governs all payment processing activities carried out through our platform
BlockMed Pro UK Ltd. reserves the right to update or modify these Terms and Conditions at any time. Changes will be effective upon posting on the Site and will be intimated to subjects via email.
We encourage users to review these Terms annually or when required, as per Service Management Policy. Continued use of the Site after any changes constitutes acceptance of the new Terms and Conditions.
These Terms are governed by and construed in accordance with the laws of the United Kingdom (UK) including England, Scotland, Wales, and Northern Ireland. Any disputes arising from or related to the use of the Site shall be subject to the exclusive jurisdiction of the UK (regional) courts.
We may terminate or suspend your access if you breach these Terms and Conditions, and/or any applicable laws. We reserve the right to suspend, terminate, or discontinue our Service for you or everyone at any point in time, temporarily or permanently. We can take any of the above steps in advance for any or all of these reasons:
Scheduled System Maintenance: We may temporarily suspend or limit access to the Service for scheduled maintenance or system upgrades. Where possible, you will be notified in advance of any planned downtime through email or an in-app notification. Any temporary suspension for maintenance or security reasons will not impact the rights of individuals under data protection law and access to data will be restored as soon as possible.
Emergency Maintenance, Integrity or Security Breach: For events where urgent action is required to protect the security and/or integrity of the Service, or to prevent/respond to a potential incident, we may suspend access without prior notice (UK GDPR Article 32(1)(b)). You will be informed as soon as possible once services are restored, including a brief explanation of the reason for suspension as needed (NHS DSPT Data Security Standard 7).
Legal matters or Non-compliance with UK GDPR, NHS, DSPT requirements: We can also suspend your account if we feel that you are misusing, abusing, or damaging the integrity of ours or any user, third-party or violating the applicable laws or agreement stated in this document. However, we will provide reasonable advance notice to all users (NHS DSPT Data Security Standard 9) and offer an opportunity to export or delete their personal data prior to final closure (UK GDPR Article 5(1)(e)).
We will not be responsible for any changes, damages, price edits, discontinuation, or suspension of/related to our Service.
